To acquire a Mortgage Loan Officer License:-
1.A loan officer has to Complete a Mortgage Lending Fundamentals course which is
being approved by the NCCOB, within three-years period time immediately from the
date of application.
2.From the date of application, a loan officer should have passed the NC
Mortgage Loan Officer Test, at an official testing center, within the stipulated
180-days period.
Loan officer license application requirement:-
• Applicants are investigated for their criminal, civil, educational,
employment/business and credit histories.
• Applicants must get a fingerprint card from the NCCOB, take it to a local law
enforcement agency to have their fingerprints made.
• Applicants must enclose the fingerprint card with their fingerprints on it,
the form (Authority for Release of Information) accepting to a state and
national criminal history record check with the application, and pay for the
actual cost of conducting the criminal and credit investigations.
• Applicants must provide their social security number. This is mandatory and
authorized under the provisions of NCGS Chapter 53 in order to conduct these
investigations.
The Mortgage Lending Act ("MLA" as codified in NCGS Chapter 53, Article 19A)
requires that the NC Commissioner of Banks ("NCCOB") can give license to any
person occupied in the business of making or brokering residential mortgage
loans. Persons or entities that must be licensed include:
• Mortgage Lenders (formerly Mortgage Bankers), which includes all mortgage
makers, except Mortgage Brokers and Table-Funding Bankers;
• Mortgage Brokers (formerly both Mortgage Brokers and Table-Funding Bankers);
and
• Loan Officers (formerly not required to be licensed under the old law).
Who does not require a Loan Officer License:-
Employees whose responsibilities are limited to clerical and administrative
tasks for his or her employer and who does not request borrowers, accept
applications, or negotiate the terms of loans on behalf of the employer are not
considered Loan Officers and do not require licenses.
Under exemption provisions of the MLA, certain mortgage lenders, brokers and
their loan officers are not required to be licensed. Generally, this includes
banks, thrifts, credit unions, their wholly-owned subsidiaries and their loan
officers. Employees of exempt entities are not required to file to claim an
exemption individually.
Requirement to get Loan Officer License renewed:-
To get loan officer licensing renewed the Loan Officer must have satisfactorily
completed eight (8) hours of continuing education courses approved by the
Commissioner. If is not bale to satisfy this criteria then he will be proved
ineligible for renewal. Normally, the course provider will submit a list of
students who successfully completed a course but each Licensee is responsible
for retaining proof of meeting this requirement.
